Welcome to Unplog. These Terms of Service ("Terms") are a legal agreement between you and Unplog ("Unplog," "we," "us," or "our") governing your access to and use of www.unplog.com and your purchase of our products (collectively, the "Services").

Please read these Terms carefully. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your state) to purchase from us. By placing an order, you represent that you meet this requirement and that the information you provide is accurate.

2. Our Products — Important Disclaimer

Unplog sells portable aromatherapy nasal inhalers made with natural essential-oil blends, intended as lifestyle and sensory products.

Our products are cosmetic/aromatic lifestyle goods, not drugs, medical devices, or therapeutic products.
Our products are not intended to diagnose, treat, cure, mitigate, or prevent any disease or health condition, and make no claims regarding cognition, stress, anxiety, sleep, focus, or any other structure/function or medical benefit.
Statements on the Site describe aromatic experiences and scent profiles only.
Essential oils are potent. Keep out of reach of children and pets. Do not ingest. Avoid contact with eyes and broken skin. Discontinue use if irritation occurs. If you are pregnant, nursing, have a medical condition, or have sensitivities or allergies, consult a healthcare professional before use. Use the product only as directed.

You use our products at your own discretion and risk, consistent with the instructions provided.

3. Orders and Acceptance

All orders are offers to purchase and are subject to our acceptance. We may refuse or cancel any order, including for suspected fraud, errors, or stock limitations.
We reserve the right to limit quantities per customer or per order.
A confirmation email acknowledges receipt of your order; it does not guarantee acceptance until we ship.

4. Pricing and Payment

Prices are listed in U.S. dollars (USD) and may change at any time before you place an order.
You are responsible for applicable taxes, which are calculated at checkout where required.
We strive for accuracy, but if a product is listed at an incorrect price or with incorrect information due to an error, we may cancel or correct the order, even after it has been submitted. If you have been charged for a canceled order, we will refund the affected amount.
Payment is processed by our third-party payment processors (e.g., Shopify Payments / Shop Pay). By submitting payment information, you authorize us and our processors to charge your selected payment method.

5. Shipping and Delivery

We currently ship within the United States only.
Estimated delivery times are not guaranteed. Title and risk of loss pass to you upon our delivery of the products to the carrier.
We are not responsible for delays caused by carriers, weather, or events outside our control. Please ensure your shipping address is correct; we are not responsible for orders sent to an incorrect address provided by you.

6. Order Cancellations

If you need to change or cancel an order, contact us at juandavidcures@gmail.com as soon as possible. We can usually only make changes before an order ships.

7. Returns, Refunds, and Exchanges

For hygiene and safety reasons, nasal inhalers are personal-use products.

Unopened products in original condition may be returned within 14 days of delivery for a refund or exchange.
Opened or used products cannot be returned unless they arrived damaged or defective.
Damaged or defective items: contact us at juandavidcures@gmail.com within 14 days of delivery with your order number and a photo, and we will arrange a replacement or refund.
Refunds are issued to the original payment method after we receive and inspect the return. Original shipping charges are non-refundable unless the return is due to our error.

A full Refund/Return Policy may be posted separately; if there is any conflict, the separately posted Refund Policy controls for return-specific terms.

8. Intellectual Property

All content on the Site — including the Unplog name, logos, product names, designs, text, graphics, images, and packaging — is owned by or licensed to Unplog and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission. You receive no ownership rights by using the Site.

9. User Conduct

You agree not to:

use the Services for any unlawful purpose or in violation of these Terms;
resell our products without authorization or misrepresent our products' nature (including making medical or therapeutic claims about them);
interfere with or disrupt the Site or its security; or
use any automated means to access the Site in a way that harms it.

10. User Content and Reviews

If you submit reviews, comments, photos, or other content (for example, on our Site or social media tags), you grant Unplog a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content for marketing and operational purposes. You represent that you own or have the rights to the content and that it does not violate any law or third-party right. We may remove content at our discretion. We do not pay for user content unless agreed in writing.

11. Email and SMS Communications (reserved — not active yet)

We do not currently send marketing email or SMS messages. Transactional messages (such as order confirmations and shipping updates) may be sent to complete your purchase.

Future use: When we launch email or SMS marketing, we will add full terms here, including, for SMS, express written consent, message frequency, "message and data rates may apply," opt-out instructions ("reply STOP to cancel, HELP for help"), and a statement that consent is not a condition of purchase, consistent with the Telephone Consumer Protection Act (TCPA) and related rules.

12. Subscriptions / Auto-Renewal (reserved — not active yet)

We do not currently offer subscription or auto-renewing purchases.

Future use: If we introduce subscriptions, we will clearly disclose all material terms before you enroll (price, billing frequency, and how to cancel), obtain your express consent, send any required reminder notices, and provide an easy online cancellation method, consistent with applicable federal and state automatic-renewal laws.

13. Disclaimers of Warranties

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free. This section does not exclude any warranty or right that cannot be excluded under applicable law.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UNPLOG AND ITS OWNER(S) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Unplog and its owner(s) from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Services or products, your violation of these Terms, or your violation of any law or third-party right.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Miami Dade County, Florida, and you consent to their jurisdiction. Nothing here limits any rights you may have under applicable consumer-protection laws.

17. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above, and changes are effective when posted. Your continued use of the Services after changes take effect means you accept the updated Terms.

18. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with our Privacy Policy and any posted Refund Policy, are the entire agreement between you and Unplog regarding the Services.
